CategoriesLaw & Legal

TTAB stands for Trademark Trial and Appeal Board, an intellectual property abbreviation.

Administrative tribunal of the USPTO that decides appeals from trademark examiners' refusals and contested cases such as oppositions to pending applications and petitions to cancel registrations. It decides only whether a mark may be registered, not infringement or damages.

Example: The rival company filed an opposition at the TTAB within 30 days of publication.

Usage notes

Oppositions are due within 30 days of publication in the Official Gazette, with extensions available. Proceedings follow federal court discovery practice, and many settle. Decisions can be appealed to the Federal Circuit or challenged in district court, and B&B Hardware v. Hargis (2015) held that TTAB findings can bind later infringement courts.
